Empowerment by way of administrative authority

to the State Government

 

It was agreed that:

  1. The State legal officers are given the powers by the Public Prosecutor under the Criminal Procedure Code to prosecute for offences under State ordinances from the lower to appeal courts;

  2. Agreed that power be given to local officers of SPA (Suruhanjaya Perkhidmatan Awam) and SPP (Suruhanjaya Perkhidmatan Perguruan) to recruit officers in the Federal Civil Service including in the teaching and health services;

  3. Posts in the Immigration Department be strengthened to enhance the department’s enforcement function in the State in regard to the new 100 additional  posts of which deployment should be completed by end of February 2016;

  4. The number of teachers drawn from Sarawakians to serve in Sarawak will be increased to the ratio of 90 % against the total population of teachers in the State by 2018. To ensure that the target is achieved, temporary teachers (guru sandaran) shall be recruited from the employment market from time to time and that they be able to obtain their Diploma in Education while teaching;

  5. Authority for local authorities to appoint traffic wardens be given to Miri City Council apart from Kuching City North Commission and Kuching City South Commission;

  6. The State Government be duly consulted before application for Deep Sea Fishing Licenses are presented to the Deep Sea Permit Evaluation Committee (JPPLD) for consideration;

  7. The State Government be duly consulted in the process of enacting Federal laws that have implications upon the state as provided for by the laws;

  8. The Federal project planning in Sarawak will give priority to the State’s Five-Year Development Planning based on approved allocations. The implementation of projects shall be referred to/discussed jointly between ministries and the State Government including matters such as location of schools, hospitals and other development projects;

  9. The Ministry will increase students’ intake from among Sarawakians to do medical degree programmes in local public universities. Sarawakians enrolment in UNIMAS’ foundation programme will also be increased;

  10. That relevant fields be identified for which authority can be delegated by the Director-General to State Officers/Department under Section 49 of the Environmental Quality Act 1974;

  11. That the implementation of public housing projects in Sarawak be undertaken via the Joint Committee Meeting with a view to fully involve State agencies in the planning, implementation and monitoring of public housing programmes in Sarawak;

  12. That sports development in Sarawak be administered jointly with the State Government. The Ministry of Youth and Sports is in the process of improving the Sports Development Act 1997 and is expected to be completed by end of 2016;

  13. That the State Government will implement all functions under the purview of the Welfare Department. All posts will be transferred to the State Civil Service. The Federal Government will contribute 50% of the costs to be borne as decided by the National Financial Council.
